SwiftTalentForge is a digital marketplace that connects clients ("Buyers") with freelance professionals ("Sellers") for the purpose of completing various digital services and projects. Our Platform facilitates:

• Project posting and discovery
• Freelancer bidding and selection
• Secure payment processing and escrow services
• Communication tools and project management
• Dispute resolution and customer support
• Quality assurance and review systems

3Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years old to use our Platform. By using our services, you represent and warrant that you meet this age requirement.

3.2 Account Information

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized account use

3.3 Account Verification

4User Conduct and Prohibited Activities

4.1 General Conduct

All users must maintain professional standards and treat others with respect. You agree to:

• Honor all agreements and commitments made through the Platform
• Provide honest and accurate service descriptions
• Respect intellectual property rights
• Comply with all applicable laws and regulations

4.2 Strictly Prohibited Activities

• Contact Information Sharing: Sharing emails, phone numbers, social media handles, or any external contact information
• Platform Circumvention: Attempting to conduct business outside the Platform to avoid fees
• Fraudulent Activities: Any form of fraud, scam, or deceptive practices
• Multiple Accounts: Creating or operating multiple accounts without permission
• Spam and Harassment: Sending unsolicited messages or engaging in harassment
• False Reviews: Creating fake reviews or manipulating the rating system
• Intellectual Property Theft: Using copyrighted material without permission
• Prohibited Content: Adult content, illegal services, or harmful material

5Services and Project Management

5.1 For Buyers (Clients)

As a buyer, you agree to:

• Provide clear, detailed project requirements
• Communicate project scope and expectations clearly
• Make timely payments for completed work
• Provide constructive feedback and reviews
• Respect intellectual property created by freelancers

5.2 For Sellers (Freelancers)

As a seller, you agree to:

• Accurately represent your skills and experience
• Deliver work that meets agreed specifications
• Meet agreed deadlines and milestones
• Maintain confidentiality of client information
• Provide original work unless otherwise specified

5.3 Project Completion and Revisions

Work is considered complete when the buyer approves the delivery. Reasonable revisions may be requested based on original requirements. Excessive revision requests beyond scope may incur additional charges.

6Payment Terms and Financial Policies

6.1 Platform Fees

SwiftTalentForge charges a service fee of 10% on all completed transactions. This fee covers:

• Secure payment processing
• Escrow protection services
• Customer support and dispute resolution
• Platform maintenance and security

6.2 Payment Processing

We use secure third-party payment processors including Stripe and PayPal. All payments are held in escrow until work is completed and approved. Payment terms include:

• Payments are processed within 24-48 hours of approval
• Refunds are subject to our refund policy and dispute resolution
• Currency conversion fees may apply for international transactions
• All prices are exclusive of applicable taxes

6.3 Escrow Protection

Our escrow system protects both buyers and sellers by holding payments until project completion. Funds are released when:

• Buyer approves completed work
• Automatic release after 7 days of delivery (if no disputes)
• Dispute resolution determines fair outcome

7Dispute Resolution

7.1 Dispute Process

If disputes arise, we encourage direct communication first. If unresolved, our dispute resolution process includes:

1. Mediation: Platform mediators review evidence and facilitate resolution
2. Evidence Review: All communication, deliverables, and requirements are examined
3. Fair Resolution: Decisions are made based on original agreements and evidence
4. Final Decision: Platform decisions on disputes are final and binding

7.2 Dispute Timeline

Disputes must be filed within 14 days of project delivery. We aim to resolve all disputes within 7-10 business days.

8Intellectual Property

8.1 Ownership Rights

Unless otherwise agreed in writing:

• Buyers receive full rights to custom work upon payment completion
• Sellers retain rights to general techniques and knowledge
• Portfolios may include completed work with client permission
• All parties must respect third-party intellectual property

8.2 Platform Content

SwiftTalentForge retains all rights to platform content, features, and branding. Users may not reproduce, distribute, or create derivative works without permission.

9Content Moderation and Safety

9.1 Automated Monitoring

Our platform employs advanced content moderation systems to:

• Detect and prevent contact information sharing
• Monitor for prohibited content and activities
• Ensure platform safety and compliance
• Protect users from fraud and scams

9.2 Enforcement Actions

Violations may result in:

• Warning: First-time minor violations
• Temporary Suspension: Repeated or moderate violations
• Permanent Ban: Serious violations or repeated offenses
• Legal Action: Criminal activities or severe policy violations

10Privacy and Data Protection

Your privacy is important to us. Our data practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference. By using our Platform, you consent to our data collection and processing practices.

11Platform Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our Platform at any time. We will provide reasonable notice for significant changes that affect your use of the service.

12Limitation of Liability

To the maximum extent permitted by law, SwiftTalentForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform. Our total liability shall not exceed the amount of fees paid by you in the 12 months preceding the claim.
